Army Officer Reinstated After 25 Years of Being Court Marshalled

The services of a second lieutenant, who was court-martialled in 1991 were restored by the Armed Forces Tribunal (AFT) after 25 years and a fine of ₹5 crore was imposed on the ministry of defence.

While the bench ordered the MoD to pay ₹4 crore to Chauhan, it asked it to deposit ₹1 crore with the Army Central Welfare Fund within a period of four months.

SS Chauhan, who was a second lieutenant in Indian Army’s 6th Rajput Battalion, was posted in Srinagar when he was court-martialled on various charges and also declared a deserter and mentally unstable.

SS Chauhan is a native of Uttar Pradesh’s Mainpuri district. He was court-martialled on November 4, 1991, and the order was approved by the then General Officer Commanding-in-Chief, Srinagar.

The rank of a second lieutenant (one star) is no longer in use in the army and all new officers are commissioned as lieutenants (two stars).

Passing the judgment on Thursday, justice DP Singh and Air Marshal Anil Chopra quashed Chauhan’s court-martial and ordered the defence ministry to reinstate the officer as well as provide him promotional avenues up to the stage of lieutenant colonel for the purpose of arrears of salary, pension benefits and rank.

“Keeping in view… mental pain, agony and humiliation suffered by the petitioner, it is a fit case where the petitioner should be awarded exemplary compensatory cost,” the bench observed.

The Case:

The officer’s ordeal began when he recovered 147 gold biscuits weighing around 27.5kg during a search operation in Srinagar on April 11, 1990.

In his petition, Chauhan pointed out that the gold biscuits were recovered from a house in the presence of other soldiers and were handed over to the then Colonel KRS Pawar and then Lt General Zaki Mohammad Ahmad.

The gold biscuits were allegedly ‘embezzled’ by the senior army officers.

The officer had taken the matter to Parliament’s Committee on Petitions. The Army headquarters ordered a separate inquiry.

During the trial, the tribunal observed that Chauhan’s senior officers implicated him in false cases to ensure that the recovery of gold could be concealed from the government.

In 1991, the court martial cut short Chauhan’s career sentencing him to seven-year jail on charges of being a deserter and mentally unstable.

Justice Singh and Air Marshal Chopra directed the chief of the army staff to look into the matter and ensure that appropriate action is taken against those who were instrumental in persecuting Chauhan and complete the inquiry in four months.

Terrorists Kill 2 Assam Rifles Jawans Escorting Tourists in Guwahati

0

2 men of Assam Rifles have been killed and 5 injured in a terror attack in Assam’s Tinsukia district this morning. The India-Myanmar border has been sealed and a massive counter-operation has been launched.

The attack was suspected to have been carried out by SS Khaplang faction of National Socialist Council of Nagaland (NSCN-K) and the Paresh Baruah faction of United Liberation Front of Assam (ULFA) along Assam-Arunachal border on Sunday morning in the run-up to Republic Day.

The attack was perpetrated at a place between Jagun and Jairampur of the inter-state border.

As the retaliation was on, dozens of vehicles, carrying both domestic and foreign tourists and heading to Pangsau Pass on the India-Myanmar border, were stranded.

Meanwhile, thousands of tourists were stuck on the NH-153 between Nampong in Changlang district of Arunachal Pradesh and Jagun in Assam.

The terrorists had used grenades and IED to ambush the Assam Rifles team at Jagun Warabasti. This is the fourth ambush by militants on security forces in the Northeast in recent months.

The Assam Rifles vehicle and three vehicles of tourists, returning from Pangsau festival, were damaged in the explosions.

The Pangsau festival is an annual winter event held in Arunachal Pradesh along the Indo-Myanmar border.

The area has been cordoned off and combing operations have been stepped up in the vicinity of the attack.

Insurgent outfits of the Northeast have their bases in Myanmar. A number of them have come under one umbrella after the formation of United National Liberation Front of Western South East Asia. Ever since its formation, they started carrying out the attacks jointly.

  7. The ATM belonging to the State Bank of India (SBI) will be operated through satellite link and the services will begin from Saturday evening.

Soldier Chandu Chavan Released By Pak Army As “Goodwill Gesture”

Indian soldier Chandu Chavan, who inadvertently strayed across the Line of Control hours after the surgical strike on terror camps in September last year, was handed over to the Indian authorities by Pakistan as a ‘gesture of goodwill’ at Wagah border today. Earlier this month, news of Chavan’s release roamed across the internet.

Pakistan Army announced that it would return Indian soldier Chandu Babulal Chavan who, Pakistan claimed had ‘willfully crossed LOC’ on September 29, 2016. Chavan was posted with 37 Rashtriya Rifles battalion.

The Indian Army maintains that Chavan’s battalion was not part of the surgical strikes and the 22-year-old crossed over from the LoC in Mendhar sector after a tiff with his superior at the post.

“Sepoy Chandu Babulal Chavan, an Indian Army soldier, deserted his post at LoC due to his grievances of maltreatment against his commanders. He willfully crossed LoC on 29 September 2016 and surrendered himself to Pakistan Army,” a press statement from Pakistan’s Inter-Services Public Relations reads.

The Pakistan Army had earlier informed its Indian counterpart that it is not aware of Chavan’s whereabouts.

Beyond established norms for individuals crossing the LoC, the two countries are also bound by Geneva Conventions on dealing with enemy soldiers in their custody, as unlike Lt Saurabh Kalia was treated.

Chandu Chavan, 22, hails from Borvihir village in Dhule district that falls under Bhamre’s Lok Sabha constituency.

Chavan’s family has been under stress since the news of his disappearance broke on September 29 last year — his grandmother died of a heart attack two days later. Chohan’s parents died when he was two years old and his grandmother Lilabai took care of her two grandsons.

Recommended For Indian Army In 5th Attempt

0

I belong to a defence background, so the passion for joining the armed forces is in my blood. My formal first step is dated back to 2005 when I gave the entrance exam for the Military Schools and to my disappointed got rejected. So I completed my schooling from Kendriya Vidyalaya NRC Nasik, and there always had been in my mind that I did loose such a great chance of being in the Military Schools, but I kept faith, as I knew there are other entries that can take me to the Academy. I am average in studies but deeply interested in sports and co-curricular activities.

NDA, the entry every teen boy is keen to apply to, so was I. I applied I didn’t make it in written for both the attempts and my percentage of Physics and Mathematics was not sufficient enough so my left over chances of TES army and Navy were reduced, I was disheartened but still kept telling myself there are other entries.

I opted for a B.Sc and took NCC, realizing it would increase my chances, and even started preparing for CDSE and AFCAT side by side. After such a long wait, I got my first SSB, for the Indian Coast Guard, and I got conference out, this took place around August 2015. Then there came many SSBs for me, AFCAT Gandhinagar in December 2015, AFCAT Varanasi in May 2016, NCC Special Entry in Allahabad in July 2016, all to my utter disappointment Conference out!!

It hit my mind that something is going wrong and it was too much of disappointment in such a short time span which at times depressed me. Something was supposed to be done to change all of this, high time it was, hence I started reading newspaper, installed various mobile apps helpful in the preparation. It was around that time that my friend Kumar Goswami opted for some professional training for the SSB Interviews. I spent time with him and Vijay, we started taking out notes from his notes, refining them further, and deeply introspecting myself, we even conducted mock PIs, practiced TAT, WAT, SRT, PPDT, and anything that the psychologist may demand, In Short I started bringing out the things already in myself shaping and presenting them profoundly, which I never took out and those very things are needed by the forces. Also the experience of my father who appeared in four SSB’s of services entry played an important role.recommended candidate army

We did this for about a few months and I felt better prepared from the previous attempts. Then came my next SSB on 28th of November 2016, i.e. after clearing the CDS in my fifth attempt.  I performed up to my expectations, and as per my performance, it was expected that I’ll be recommended, even though knowing that, when my name was announced after the conference, I was in tears, I actually burst out in tears, I was in tears till I reached the phone booth, and even after I called home and friends, every struggle and the hard work I put into, paid, not just paid, but paid beyond my imagination, got +104 chest number on  2nd of December 2016 and realized that all the humiliations proved to be a great source of inspiration.

I would like to suggest to aspirants that practice psychology well before going to SSB. For screening do well in verbal and non verbal, write simple story and narrate it effectively also take part in GD putting simple points.   Prepare you SD well and try to come up with simple stories which should reflect you and your qualities also try to attempt as many as WAT and SRT. Be active also help, coordinate and lead the group in GTO. Motivate the group in snake race and always remember ‘’TEAM WORK’’.  And at last introspect yourself well, your weakness, strong’s, family, friends, hobbies. You never know what interviewer may ask. So ‘’Be Prepared’’

My family’s patience was commendable that despite so many downfalls their faith in me never trembled, and all the friends who kept me busy and the teachers who kept motivated are all a part of my accomplishment. Just after my recommendation, I headed off for my medicals and was labelled medically fit. Now I’m waiting for the merit list and as from my past experiences I’m “patiently” waiting for that. I read this statement in the Allahabad SSB Candidates’ mess that, “When the going gets tough, the tough gets going”. So, taking mindful, calculative and definite steps towards your goal can bring out the best in you and not to mention will take you to your goal, sooner or later.

At last thankyou Sukanya Wable for framing my Happiest Experience…!!!
