Delete Facebook Or Quit Indian Army : Delhi High Court To Army Officer

The Delhi High Court on Tuesday declined to grant any interim relief to a senior army officer, who has challenged the Indian Army’s recent policy banning armed forces personnel from using social networking platforms like Facebook and Instagram, saying he has to either abide by the mandate of the organisation or put in his papers. The high court said he has a choice to make and asked him to delete his Facebook account as the policy to ban the use of social networking platforms for army personnel was taken keeping in view the security of the nation.

It said he can create a new social media account later. A bench of Justices Rajiv Sahai Endlaw and Asha Menon said that when it has not even found a reason yet to entertain the plea, “the question of granting any interim relief does not arise. Especially when the matter has the potential of concerning the safety and security of the country,” the bench said. Lieutenant Colonel P K Choudhary contended that once deleted all the data, contacts and friends in his Facebook account would be “irretrievably lost” and the loss would be “irreversible”.

“No. No. Sorry. You please delete it. You can always create a new one. It cannot work like this. You are part of an organisation. You have to abide by its mandate,” the bench said. It further said, “If you are so dear to FB, then put in your papers. See you have to make a choice, what do you want to do. You have other choices which are also irreversible.”

The army officer had sought an interim relief that he be allowed to retain his Facebook (FB) account in deactivated form till the next date of hearing when the court will decide whether to entertain his petition after going through the Army’s policy under challenge. According to the new June 6 policy, all Indian Army personnel have been ordered to delete their accounts from Facebook and Instagram and 87 other applications.

The counsel for the army officer said the only choice he has is whether to face departmental action for not deleting the account. The officer’s lawyer repeatedly urged the bench to allow him to retain the account in deactivated form, saying forcing him to delete it and the data therein amounts to violation of his right to privacy. The Centre, represented by Additional Solicitor General (ASG) Chetan Sharma, told the court that the policy decision was taken as “we found that Facebook was a bug. It was infiltrating as a cyber warfare and there were so many instances of personnel being targeted”.

ASG Sharma also said the petitioner’s grievance was that he needs Facebook to communicate with his family in the US, when there were other modes of communication like WhatsApp, Twitter and Skype which were available to him. After hearing him for some time, the bench said it finds no ground to grant the interim relief. It asked the ASG to file the policy document in a sealed cover for perusal by the bench and said the reasons for taking the decision be also filed.

With the direction, the court listed the matter for hearing on July 21. The petition has sought a direction to the Director General of Military Intelligence to withdraw its June 6 policy to the extent that it orders all the members of the Indian Army to delete their accounts from Facebook and Instagram and 87 other applications.

Lt Col P K Choudhary, who is currently posted in Jammu and Kashmir, said in the plea that he is an active user of Facebook and uses the platform to connect with his friends and family as most of them are settled abroad, including his elder daughter. In the petition, the officer has sought a direction to the Ministry of Defence to withdraw the June 6 policy to ensure that the fundamental rights of armed forces personnel are not abrogated amended or modified by arbitrary executive action which is not backed by the mandate of law, offends the provisions of the Army Act and Rules made thereunder and is unconstitutional.

The petition has alleged that the policy which bans social media platforms is illegal, arbitrary, disproportionate, violates the fundamental rights of soldiers including but not limited to the freedom of speech and expression, the right to life and the right to privacy. It has said the authorities have cited security concerns and risk of data breach as the basis of imposing the restrictions contained in the policy regarding usage of social media platforms but the act of banning it is a clear violation of Article 14 (Equality before law) of the Constitution.

The plea also seeks a declaration that the Director General of Military Intelligence is not empowered under the Constitution or under any other law to modify, amend or abrogate the fundamental rights of the petitioner and other members of the armed forces. Besides, the Centre and Director General of Military Intelligence, the petition has also made Chief of the Army Staff, who is the professional head, commander and the highest-ranking military officer of the Indian Army, party to the petition.

Cracked SSB Interview In 7th Attempt – NCC Entry

1
ssb-interview-experience

After reaching SSB centre and finishing up with all the Documentation, I had undergone OIR Test and done excellent this time. From my side accuracy was 95 out of 100. Then We got PPDT image of Group of Guys and Girls (College Students) moving with a backpack and they were in Casual Attire, nothing special instrument was there with them. Their age was around 22 to 25 and all were in Positive Mood. I made Ram a main Hero of the Story and story was like-Ram was Graduation student and active participant of NSS team. After flood situations, District authorities Set up one rehabilitation centre in the core part of the city. And NSS Students got the task to help and support at Rehabilitation centers.Ram along with his college NSS team and other friends went there to help out. Another college NSS Teams were also present there.Ram gathered all the teams and their seniors and took the responsibility of distribution of food packets, medication and other essentials like a blanket, clothing etc. They made small teams by mixing all college’s students. And gave responsibility to each group. Group distributed things with checklist and demanded further requirements also. At the end of the day, Ram with few seniors went through all the groups to check further requirements and done the survey of distribution to make a report. They submitted a report and got line up for the next day and reverted to their House. Story Finished.

ssbinterviewbook

During Narration, I wasn’t stupendous but fluency was their 80%. I was loud, modulation was there and eye contact was thorough. For discussion, our group was divided into a subgroup of 10. During the discussion, I was progressive and taking everyone’s maximum accepted by the group and sharing my also to contribute actively.

After Screening in, for Psych Tests, I went through my own notes and just memorised myself. That is what I am. I am a good person.simple by heart, helping one, cooperative, I can lead I have command qualities. I went through all activities done by me to help others, responsibilities shouldered by me throughout in all situations of my life. For TAT my stories were simple. Whatever first thought came to my mind I wrote it down. It was honestly written response by me. Actually my subconscious mind was responding as I was not trying to camouflage anything. I wasn’t pretending this time.

spot_img

AFTER SEEING THE STIMULUS WHATEVER RESPONSE CAME TO MY MIND I EXPRESSED IT THROUGH MY WRITINGS IN THE FORM OF STORIES. For WAT Again simple way is whatever I felt after seeing the word I wrote it down.No calculations were made. Eg. COOPERATION creates healthy bondings. 57 WATs attempted.

For SRT this time I focused on each and every SRT as per the seriousness it requires… The deeper is the seriousness the more logical sequence was there in response. 45 SRTs attempted.

I was handling multiple activities like co-curriculum, NCC and many things. So it took me a bit time to increase my marks n come up to 60 % till my graduation.

My interview was running max for half an hr. It was a shorter time-wise but Multiple questions he asked and areas he entered.

In GTO 1, for PGT in the first task, I was leading in the second one I was at last with load and third one I was in Middle order. There was no strategy, actually, I performed on the basis of Solution I was getting. But throughout I was giving Solution helping others. 3 out of the 4 tasks we finished.
For GD I was Sharing my views and listening to all. I was there as Suryabhan the way actually I use to be in normally while discussion, in the same way, I was there in GD. My friend Shourya and Shubham Nisal telling me after GD that Once I was waving my hand nearby Shaurya’s Face.

For MPE I again prioritised problems with respect to seriousness. Life is foremost imp. Then Casualty, Then finding something or an object. But one should remember the main plan or aim of our team that we have to reach somewhere within the time for an imp event.

For HGT again we did our best. For Lecturett, I have got the topic Google. I chose Google from four on my card. And I rocked it. Utilised full time. Eye contact with all. And confidence…

oir test and ppdt

GTO 2In Individual Obstacle did 14 obstacles.
For Command Task again GTOwas interacting with me for around 15 mins. He asked me multiple questions and stressed out my English communication and how did I improve my English as I was from Marathi medium till 10th. Also asked me multiple questions regarding my NCC career. In command task, Milan and Mahesh were there as my subordinates. And the bomb was there.GTO pressurised me a lot.

I did it. With all three solutions as GTO was closing every wat after I was finding Solution.
Snake race we rocked. And FGT also.

Conference day-I was waiting outside for approx 15 mins and was there inside for 15 mins again.
Respected officers asked me about Ranking my Performance where I gave first ranking to Psych and GTO and second to my Personal Interview. Officer asked me a reason. I gave a reason, that I was unable to answer all the GK few I answered wrong. Officer again asked me to repeat all the GK questions and answers and added few to question list.
